Overview
The proposed development site (which surrounded an original homestead) was zoned Residential Low Density. Requiring a minimum lot size of 2000 m2, there was no opportunity for the developer to subdivide the site under that zone.
Acting as town planning expert witness for the developer, Natalie Rayment argued the zoning and lot size specifications Council based its decision on were outdated and no longer relevant and presented Residential A density as a more efficient urban form for the area.
Outcome
Council’s refusal was overturned by the Planning and Environment Court and the development was allowed to proceed.
289 Ipswich Road, Annerley
The applicant sought approval for a Shop on Ipswich Road, Annerley.
Overview
The site and adjoining land were included in a residential designation under the Brisbane City Plan, with land directly opposite included within a centre designation.
Acting as town planning expert witness for the developer, Natalie Rayment attended Without Prejudice negotiations with Council. The case for the developer was based on an overwhelming community need for the proposed out-of-centre development which could not be addressed within the existing centre. The proposed site was argued to be suitable to respond to this community need given its proximity to the established centre.
Outcome
Assisted by expert economic advice, a settlement was reached with Council which allowed the development to proceed without the need for a Court hearing.
